1. Definitions
- Hirer: The person, company, or organisation hiring the equipment.
- Equipment: All audio / electronics and lighting equipment and accessories supplied by the Company for hire.
- Company/Owner: The audio hire company supplying the equipment, Redsound.
- Hire Period: The period from the time the equipment is collected or delivered to the Hirer until it is returned to the Company.
2. Booking Deposit / Booking Fee
- A non-refundable deposit is required to secure a booking. The deposit amount is 20% of the total hire cost.
- The deposit must be paid at the time of booking, and payment confirms acceptance of the company’s terms and conditions.
3. Security Deposit
- A security deposit is required before the hire commences. The amount is equal to the hire cost.
- The security deposit should be sent via bank transfer, and is refunded after the safe, timely, and complete return of all equipment, provided there is no damage or loss.
- The security deposit does not limit the hirer’s liability; if loss or damage exceeds the deposit, the hirer is responsible for the full replacement or repair cost.
4. Payment Terms
- The remaining balance of the hire fee is due at least 7 days before the hire date along with the security deposit.
5. Cancellation Policy
- If the hirer cancels, the booking deposit is non-refundable
- If full payment is not received by the deadline, the booking may be cancelled and the deposit forfeited.
6. Refund of Security Deposit
- The security deposit is refunded after all equipment is returned in satisfactory condition and all outstanding charges are settled
- If there is any loss, damage, or late return, deductions are made from the deposit, or additional charges may be levied if the costs exceed the deposit
6. Identification and Documentation
- Proof of identity (e.g., passport or driving licence) and proof of address matching those on the booking are required before equipment is released to the hirer.
- The company may retain ID until the equipment is returned or may require card details as further security.
7. Provision of Equipment
- The Company agrees to supply the Equipment described in the hire agreement for the agreed Hire Period.
- All Equipment is supplied in good working order. Any defects must be reported immediately upon receipt for prompt replacement or repair.
- Equipment remains the property of the Company at all times.
8. Hirer’s Responsibilities
- The Hirer assumes full responsibility for the Equipment from the time of receipt until return.
- The Hirer must inspect the Equipment on delivery or collection and notify the Company immediately of any discrepancies or defects.
- The Equipment must be used only for its intended purpose and not altered or modified without prior written consent.
- The Hirer shall not sub-hire, sell, assign, mortgage, or lend the Equipment to any third party without the Company’s permission.
- The Hirer is responsible for providing adequate security and insurance (including public liability and theft/damage) for the Equipment during the Hire Period.
- The Hirer must ensure competent personnel operate the Equipment. If specialist knowledge is required and not available, the Company can provide qualified staff at additional cost.
9. Loss or Damage
- The Hirer is liable for any loss, theft, or damage to the Equipment during the Hire Period, including damage caused by third parties, adverse weather, or inadequate handling.
- The cost of repair or replacement will be charged to the Hirer in full.
- Equipment lost or damaged will continue to incur hire charges until the matter is resolved.
10. Hire Charges and Payment
- Hire charges are calculated based on daily or weekly rates as specified in the hire agreement.
- Payment must be made in full before the Equipment is released.
- Late payment may result in termination of the contract and loss of any discounts offered.
- Additional charges may apply for extended hire periods, overtime for crew, delivery, or other services.
10. Delivery and Collection
- Delivery and collection times must be agreed in advance.
- The Hirer is responsible for ensuring access and suitable conditions for delivery, installation, and collection.
- Any delays or additional costs incurred due to the Hirer’s failure to provide access or suitable conditions may be charged.
11. Liability and Indemnity
- The Company’s liability is limited to the repair or replacement of defective Equipment.
- The Hirer indemnifies the Company against all claims, losses, damages, or expenses arising from the use or misuse of the Equipment.
- The Hirer is responsible for obtaining any necessary licenses or permissions for the use of the Equipment.
12. Termination
- The Company may terminate the hire contract if the Hirer fails to pay, breaches any terms, or jeopardises the Company’s rights in the Equipment.
- Upon termination, the Hirer must return the Equipment immediately.
13. Governing Law
- These terms and conditions are governed by English law and any disputes shall be subject to the exclusive jurisdiction of the English courts.
